Definitions
For purposes of this Agreement, "Cali Dream Athletics" shall include Cali Dream Athletics, its owners, officers, directors, members, managers, employees, coaches, instructors, volunteers, agents, independent contractors, affiliates, successors, and assigns.

Assumption of Risk
I understand that participation in gymnastics, tumbling, cheerleading, dance, camps, clinics, open gyms, competitions, performances, special events, strength and conditioning activities, and the use of gymnastics or cheerleading equipment involves inherent risks that cannot be completely eliminated regardless of the care taken to avoid injuries.

These risks include, but are not limited to, falls, collisions with equipment or other participants, improper landings, overuse injuries, sprains, strains, broken bones, dislocations, concussions, spinal cord injuries, paralysis, permanent disability, and, in rare cases, death.

I knowingly and voluntarily assume all known and unknown, foreseeable and unforeseeable risks associated with participation in any activity offered by Cali Dream Athletics, whether arising from the condition of the premises, equipment, acts or omissions of other participants, or the inherent nature of the activities themselves.

Medical Fitness Certification
I certify that the participant is physically capable of safely participating in all activities offered by Cali Dream Athletics and has no medical condition that would make participation unsafe unless such condition has been fully disclosed in writing to Cali Dream Athletics before participation.

I understand that it is my responsibility to notify Cali Dream Athletics of any changes in the participant's medical condition.

Medical Authorization
If I cannot be reached during an emergency, I authorize Cali Dream Athletics to obtain emergency medical treatment deemed reasonably necessary for the participant.

I authorize emergency medical personnel, physicians, hospitals, and healthcare providers to administer appropriate treatment.

I further authorize Cali Dream Athletics staff to administer reasonable first aid within the scope of their training while awaiting emergency medical personnel when appropriate.

I authorize transportation by ambulance or other emergency medical services if deemed necessary.

I understand and agree that I am solely responsible for all medical expenses incurred as a result of participation, regardless of insurance coverage.

Personal Property Disclaimer
Cali Dream Athletics shall not be responsible for the loss, theft, or damage of any personal property brought onto its premises or to any practice, competition, camp, clinic, performance, or off-site event.

Participants are solely responsible for securing their personal belongings.

Photo & Media Release
I grant Cali Dream Athletics permission to photograph, videotape, audio record, or otherwise capture the participant's image, voice, likeness, or performance during any activity.

I authorize Cali Dream Athletics to use these materials for advertising, marketing, promotional, educational, fundraising, social media, websites, printed materials, broadcasts, and any other lawful business purpose without compensation.

This authorization shall remain in effect indefinitely unless revoked in writing; however, any materials created or published before such revocation may continue to be used.

I waive any right to inspect or approve the finished product and release Cali Dream Athletics from any claims relating to the use of the participant's name, likeness, image, or voice to the fullest extent permitted by law.

Release of Liability
To the fullest extent permitted by California law, I release, waive, discharge, and covenant not to sue Cali Dream Athletics from any and all claims, demands, actions, causes of action, damages, losses, liabilities, costs, expenses, attorney's fees, or judgments arising out of or relating to participation in any activity offered by Cali Dream Athletics, except to the extent such claims arise from gross negligence or willful misconduct where liability cannot legally be waived.

Entire Agreement
This Agreement constitutes the entire understanding between the parties concerning participation in Cali Dream Athletics programs and supersedes all prior oral or written representations, agreements, understandings, or communications regarding the subject matter herein.

No verbal statement made by any employee, coach, instructor, or representative shall modify this Agreement unless such modification is made in writing and signed by an authorized representative of Cali Dream Athletics.

Governing Law & Venue
This Agreement shall be governed by and construed in accordance with the laws of the State of California.

To the extent any legal action is permitted under this Agreement, exclusive venue shall lie in the county where Cali Dream Athletics' principal place of business is located, unless otherwise required by law.

Force Majeure
Cali Dream Athletics shall not be liable for cancellations, schedule changes, interruptions of services, or failure to perform resulting from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, public health emergencies, government orders, fires, floods, power outages, labor disputes, or other unforeseen events.

Arbitration Agreement & Waiver of Jury Trial
The parties agree to first attempt in good faith to resolve any dispute informally.

If the dispute cannot be resolved, any claim arising out of or relating to this Agreement or participation in Cali Dream Athletics activities shall be resolved through final and binding arbitration in California before a neutral arbitrator, in accordance with the applicable rules of the arbitration provider selected by mutual agreement or, if no agreement is reached, as determined by a court of competent jurisdiction.

The arbitrator shall have the authority to award any remedy available under applicable law. Judgment upon the arbitration award may be entered in any court having jurisdiction.

Each party shall generally bear its own attorney's fees unless otherwise required by law or awarded by the arbitrator.

Nothing in this provision prevents either party from filing an action in small claims court if the dispute qualifies under applicable law, or seeking temporary emergency injunctive relief from a court where legally permitted.

BY SIGNING THIS AGREEMENT, THE PARTIES UNDERSTAND THAT THEY ARE WAIVING THEIR RIGHT TO A JURY TRIAL AND AGREE THAT DISPUTES COVERED BY THIS PROVISION SHALL BE RESOLVED THROUGH BINDING ARBITRATION.

If any portion of this arbitration provision is found unenforceable, the remaining portions shall remain in full force and effect to the fullest extent permitted by law.
